By engaging with JOHN F PARKER for bespoke footwear services, you agree to the following terms and conditions. These terms are designed to ensure clarity and mutual understanding throughout our creative process.
Section 1: Introduction to Agreement
This agreement defines the relationship between the client and JOHN F PARKER (hereafter referred to as "the Atelier") regarding the provision of bespoke footwear and related services. Acceptance of a commission constitutes agreement to these terms.
Section 2: Bespoke Orders Process & Payments
- Deposits: A non-refundable deposit of 50% of the total estimated cost is required to commence bespoke shoemaking work, covering material acquisition and initial design consultation.
- Final Payments: The remaining 50% balance is due upon successful completion of the final fitting, prior to the delivery of the finished bespoke footwear.
- Fitting Adjustments: JOHN F PARKER guarantees the fit of our bespoke shoes based on the client's measurements and feedback during fittings. Reasonable adjustments required post-delivery due to minor fitting issues will be addressed at the Atelier's discretion within 30 days of receipt.
- Delivery Timelines: Estimated delivery times will be provided at the time of order and are subject to material availability and existing workshop schedule. The Atelier will communicate any significant delays proactively.
Section 3: Cancellations and Refunds
Due to the highly personalized and labor-intensive nature of bespoke shoemaking, commissions are non-refundable once the deposit has been paid and work has commenced. In exceptional circumstances, and at the sole discretion of JOHN F PARKER, a partial credit may be considered for future services if cancellation occurs very early in the design phase.
Section 4: Limitation of Liability
JOHN F PARKER is not liable for damages exceeding the cost of the bespoke footwear itself. We are not responsible for wear and tear, misuse, or damage caused by improper care of the shoes once delivered. Care instructions will be provided at the time of delivery.
Section 5: Governing Law
These terms and conditions are governed by and construed in accordance with the laws of the State of South Carolina, USA, without regard to its conflict of law principles. Any disputes arising hereunder shall be resolved in the courts of West Columbia, SC.
